Who Designs the Rules of Artificial Intelligence in Europe?
When the European Union’s AI Act entered into force, it was presented as a historic moment. Europe, once again, had set a global standard. In Brussels, the ceremony marked not merely a legislative milestone but a declaration of intent: artificial intelligence would not evolve unchecked. It would be governed.
Yet legislation is only the beginning of power.
Laws are text. Governance is architecture. Between the formal proclamation of democratic control and the operational reality of risk dashboards, audit trails and compliance matrices lies an invisible layer — one that determines how artificial intelligence will actually function inside European institutions and corporations.
That layer does not reside in Parliament. It resides in translation.
Margrethe Vestager framed the AI Act as a defining achievement of European democracy:

Vestager describes a “framework” and a “launchpad”. The language is institutional and aspirational. It implies that the rules have been set and that innovation can now proceed safely within them.
But frameworks do not operate themselves.
Between Brussels and the boardroom, a second architecture emerges — one that operationalises ethics into procedures and principles into spreadsheets. This is the governance layer.
From Political Text to Operational Code
The AI Act categorises systems into risk tiers: unacceptable risk, high risk, limited risk, minimal risk. It mandates documentation, human oversight, data governance standards and conformity assessments. It appears comprehensive.
But risk classification is not self-executing. It must be interpreted, modelled, implemented and audited. The legal categories become operational questions:
- How is “high risk” quantified?
- Who determines whether human oversight is sufficient?
- How is bias measured?
- What constitutes adequate documentation?
- Which models require continuous monitoring?
These are not philosophical questions. They are design decisions.
Laurent Gobbi, Global AI Leader at KPMG, has explicitly framed the AI Act as a structural shift rather than a compliance add-on:
“It is crucial that we ensure AI is developed and used with a focus on safety, ethics and sustainability to gain and maintain society’s trust in this technology. Gobbi’s comparison to the privacy revolution is revealing. The General Data Protection Regulation (GDPR) did not simply impose fines; it reshaped internal corporate structures. Data Protection Officers were appointed. Processes were redesigned. Entire markets for compliance tools emerged.
AI governance appears poised to follow the same path.
But if GDPR created a data protection industry, the AI Act is creating a governance industry.
The Governance Industrial Complex
In the aftermath of major regulation, a predictable ecosystem forms. Consultants, auditors, technology vendors and legal advisors develop methodologies to interpret and implement the law. Over time, these methodologies become de facto standards.
The paradox is subtle but profound: democratic legislation establishes the outer boundary, but private frameworks determine how that boundary is navigated.
Deloitte’s advisory guidance on the AI Act captures this shift in tone from law to product:

The instruction is no longer “read the law”. It is “choose a framework”.
Frameworks are powerful. They define categories, scoring mechanisms, reporting structures and risk tolerances. They operationalise values into checklists. They create auditability — and with it, legitimacy.
But they also shape outcomes.
Who defines what constitutes “trustworthy AI”? Who determines the methodology by which fairness is tested? Who sets the thresholds that differentiate acceptable bias from unacceptable bias? In practice, these definitions are embedded in privately developed governance tools.
This is not conspiracy. It is institutional gravity.
Large professional services firms operate at the intersection of government advisory and corporate compliance. They contribute to consultations, advise ministries on implementation pathways and subsequently assist enterprises in adapting to the same frameworks. Their influence is rarely theatrical; it is procedural.
The language of governance itself becomes standardised.
Luciano Floridi, one of Europe’s leading thinkers on AI ethics, described ethical systems as foundational layers:
“Ethical systems provide fundamental frameworks, including principles, values and rules, that define substantive content and boundaries for action. Floridi’s use of the word “layer” is more than metaphorical. In digital architecture, foundational layers constrain everything built above them. In governance architecture, ethical definitions shape operational choices.
The question is not whether Europe has ethical ambitions. It clearly does. The question is who translates those ambitions into executable structures.
The Regulatory Capture of Language
Power in governance often resides not in enforcement, but in vocabulary.
Terms such as “human-centric AI”, “trustworthy systems” and “risk-based approach” appear neutral. Yet once operationalised, they require metrics. Metrics require thresholds. Thresholds require justification.
When consultancies and advisory bodies produce template methodologies, they effectively codify the meaning of these terms. Over time, boards, regulators and auditors converge around common interpretations.
Language stabilises. Interpretation narrows.
This process can be stabilising and constructive. It reduces uncertainty. It creates comparability. It enables cross-border alignment. But it also centralises interpretive authority.
In this sense, governance becomes both a shield and a filter. It protects against risk while shaping who can participate in the market.
The Paradox of Sovereignty
Europe’s AI Act is often framed as an assertion of sovereignty — a demonstration that technological development can be aligned with democratic values.
Yet a paradox emerges.
The compliance architecture that governs European AI systems frequently operates on global cloud infrastructure. The methodologies used to assess risk are often developed by multinational firms headquartered outside continental Europe. The tools that measure bias or monitor model performance may rely on proprietary platforms.
Is European AI governance an exportable model — or an imported operational framework layered onto European legislation?
The sovereignty debate thus shifts from hardware to governance software.
If cloud infrastructure represents the hardware of power — where data resides — then governance frameworks represent the software of power — what data is allowed to do.
Europe may legislate at the political level, but its operational sovereignty depends on how independently it can design and maintain the governance layer itself.
Governance as Market Gatekeeper
There is a further implication.
Complex governance regimes can unintentionally raise barriers to entry. Large enterprises can absorb the cost of comprehensive risk audits, external advisory services and continuous compliance monitoring. Smaller innovators may struggle.
When governance becomes sophisticated and multi-layered, it risks favouring those who can afford structured compliance ecosystems.
This raises an uncomfortable but necessary question:
When governance becomes a product — sold as a service, packaged as a framework, embedded in enterprise software — who governs the governors?
This is not an accusation. It is a structural inquiry.
Europe’s ambition to align AI with democratic values is substantial and serious. But the durability of that ambition depends on transparency within the governance layer itself.
Beyond the Ceremony
The entry into force of the AI Act was a political event. The implementation of the AI Act is an architectural process.
In the coming years, the most consequential debates may not take place in plenary sessions, but in working groups designing conformity assessment methodologies; in boardrooms evaluating risk dashboards; in audit committees determining acceptable thresholds; in advisory meetings translating legislative language into operational controls.
The governance layer is where ethics becomes code and where sovereignty becomes procedure.
If cloud infrastructure determines where power is physically anchored, governance architecture determines how that power behaves.
