The AI Act Explained: Europe’s Risk Pyramid

Decoding the architecture of the world’s first comprehensive AI law

For decades, regulation followed sectors. Governments wrote rules for banks, hospitals, airlines or energy utilities, each with their own supervisory authorities and compliance frameworks. Artificial intelligence disrupts that model. An algorithm designed to screen job applicants today might tomorrow be used to diagnose medical conditions or evaluate creditworthiness. The technology travels easily across industries, making traditional sector-based regulation increasingly difficult.

Europe’s answer was to regulate something more fundamental than industries or companies. Instead, lawmakers decided to regulate the risk posed by algorithmic systems themselves.

The result is the Artificial Intelligence Act, the world’s first comprehensive legal framework designed specifically to govern artificial intelligence. Rather than banning AI outright or allowing unrestricted innovation, the law introduces a structured hierarchy that classifies AI applications according to the potential harm they might cause to individuals or society.

At the centre of this architecture sits what policymakers often describe as the risk pyramid—a framework that distinguishes between harmless applications, systems that require transparency and those that demand strict regulatory oversight.

Vestager’s remark reflects the philosophical shift embedded in the legislation. The law does not attempt to control artificial intelligence as a technology. Instead, it focuses on how AI systems interact with people, institutions and fundamental rights.

Why Europe chose a risk-based model

Artificial intelligence has rapidly spread into nearly every sector of modern economies. Algorithms now guide decisions in banking, healthcare, education, employment, logistics and public administration. Attempting to regulate each of these sectors individually would have produced an endless legislative process.

European policymakers therefore adopted a horizontal approach. The central question is not which industry uses AI, but what the system actually does and how much risk it creates.

Breton’s formulation illustrates the ambition behind the law. Artificial intelligence is no longer seen purely as an engine of innovation but also as a system capable of amplifying bias, opacity and power asymmetries. The AI Act therefore attempts to embed safeguards directly into the development and deployment of algorithmic systems.

The risk pyramid provides the institutional tool for achieving this balance.

The pyramid of risk

At its core, the AI Act divides artificial intelligence systems into four categories, each corresponding to a different level of regulatory scrutiny.

Unacceptable risk: the forbidden zone

At the top of the pyramid sit applications considered incompatible with European values and fundamental rights. These systems are effectively prohibited within the European Union.

Examples include forms of social scoring, where governments evaluate citizens based on behaviour or social characteristics. Certain manipulative systems designed to exploit vulnerabilities—particularly among children or vulnerable groups—also fall within this banned category.

These prohibitions signal the EU’s attempt to draw clear ethical boundaries around the use of artificial intelligence.

High risk: the regulated core

The largest and most consequential category of the AI Act is known as high-risk AI. These systems are not banned, but they are subject to strict regulatory requirements before they can be deployed.

High-risk applications include AI systems used in:

  • credit scoring and financial services
  • recruitment and workforce management
  • education and student evaluation
  • medical devices and diagnostics
  • critical infrastructure such as energy or transport

In these domains, algorithmic decisions can significantly influence an individual’s opportunities, rights or safety. As a result, companies and institutions must comply with detailed requirements regarding documentation, data quality, transparency and human oversight.

The law effectively turns algorithmic development into a compliance discipline similar to aviation safety or pharmaceutical regulation.

Limited risk: transparency obligations

A third category covers AI systems that present a lower but still meaningful level of risk. These applications are allowed but must meet transparency requirements.

Typical examples include chatbots or generative AI systems. Users must be informed when they are interacting with artificial intelligence rather than a human. Similarly, synthetic images, audio or video—often referred to as deepfakes—must be clearly labelled.

The objective is not to restrict these tools but to ensure that citizens understand when algorithmic systems are involved.

Minimal risk: the free innovation zone

The vast majority of AI applications fall into the lowest category of minimal risk. These systems can continue to operate without additional regulatory requirements.

Spam filters, recommendation engines or AI tools embedded in video games are typical examples. By leaving these applications largely untouched, European lawmakers sought to avoid unnecessary constraints on innovation.

In effect, the pyramid concentrates regulatory attention where algorithmic decisions intersect most directly with human rights and societal outcomes.

Opening the black box

Behind the pyramid lies a deeper ambition: forcing algorithmic systems to become more transparent and accountable.

Modern machine-learning models often function as black boxes, generating predictions or classifications without offering clear explanations. In sectors such as finance, healthcare or employment, this opacity creates profound risks.

Tegmark’s observation captures a central concern among researchers and policymakers: automation bias. Humans tend to trust algorithmic outputs even when those outputs may be flawed or biased.

To address this risk, the AI Act introduces several key principles.

Explainability requires that high-risk systems produce results that can be interpreted by human operators. Bias control obliges developers to monitor training data for discriminatory patterns. And human oversight ensures that algorithmic decisions can be reviewed, challenged or overridden by people.

Together, these principles aim to transform artificial intelligence from an opaque technical tool into a system that remains accountable to human institutions.

Where the pyramid matters most

Although the AI Act applies across industries, its impact will be particularly visible in sectors where algorithmic decisions carry significant social consequences.

In the financial sector, AI models increasingly determine credit scores, risk assessments and fraud detection. In labour markets, recruitment platforms use machine learning to filter job applications or evaluate performance. Education systems are experimenting with automated grading tools and predictive analytics.

Public administration may face the most sensitive challenges. Governments are already deploying AI to detect tax fraud, manage welfare systems and analyse large volumes of public data.

In each of these domains, a faulty or biased algorithm can alter life trajectories—affecting access to employment, financial services or social support.

The challenge of implementation

Passing the legislation was only the first step. The real test lies in implementation.

Companies developing high-risk AI systems must now navigate complex compliance requirements, from documenting datasets to establishing monitoring mechanisms and internal governance procedures. Regulators must create new supervisory structures capable of auditing algorithmic systems that can be extraordinarily complex.

Tudorache’s warning highlights the delicate balance facing European policymakers. Excessive regulatory burdens could discourage innovation, particularly among smaller technology companies that lack the resources of large multinational firms.

Finding the right equilibrium between oversight and innovation will determine whether the AI Act strengthens Europe’s technological ecosystem or slows it down.

Europe’s global governance experiment

Beyond its technical provisions, the AI Act represents a broader geopolitical experiment. Europe may not dominate the global market for AI platforms, but it remains a powerful rule-maker.

By establishing the first comprehensive regulatory framework for artificial intelligence, Brussels hopes to shape global standards for trustworthy AI—much as it did with data protection.

Whether the rest of the world follows Europe’s approach remains uncertain. But one thing is clear: the risk pyramid now provides the blueprint for how one of the world’s largest economic blocs intends to govern artificial intelligence.
